1. Definitions

2. General

2.1 The Terms and Conditions define the rules for using the Website and the services provided through the Website.

2.2 Use of the Website through the website is possible provided that the following technical requirements necessary for cooperation with the ICT system are met:

a.​ access to the Internet,

b.​ JavaScript and cookies enabled,

c.​ possession of appropriate software, including at least one of the following web browsers: Internet Explorer, Microsoft Edge, Google Chrome, Mozilla Firefox, Opera, Safari, Brave, Vivaldi, Arc in their current versions. Use of outdated versions of these browsers may result in the Website not functioning properly.

2.3 Users of the Website are prohibited from providing illegal content and from interfering with the content of the Website without the consent of IPH.

2.4 Users may access these Terms and Conditions at any time via a link on the Website’s home page and download and print them. A paper version of the Terms and Conditions is also available at IPH’s registered office.

2.5 IPH asks you to read the Terms and Conditions before using the Website. If you do not accept the Terms and Conditions in whole or in part, IPH asks that you refrain from using the Website.

2.6 Subject to the provisions of the following sentence, the services available through the Website are provided by IPH. External services may also be available through the Website, which will operate based on the rules set by third parties providing these services.

2.7 Use of the Website and the services available through it constitutes acceptance by the User of the terms and conditions set out in the Terms and Conditions and acceptance of the Privacy Policy, whereby the terms and conditions of use of individual services through the Website may require acceptance of specific Terms and Conditions for a given service.

2.8 The User is obliged to comply with the provisions.

2.9 The Service Provider reserves the right to restrict access to selected services offered through the Website to Users who meet certain conditions. Restrictions on the use of selected services will be posted on the Website’s web pages each time they are imposed.

2.10 The Service Provider has the right to entrust the day-to-day operation of the Website to a subcontractor on its own behalf, without informing Users.

2.11 IPH provides the following services through the Website:

  • information services regarding IPH’s offer;
  • browsing the content of the Website;
  • a contact form service enabling Users or Visitors to contact IPH by sending a message using the form available on the Website in the “Contact” tab;

2.12 The Terms and Conditions do not apply to the provision of services via the Website by entities other than IPH, which shall bear full responsibility in this respect, unless otherwise specified in the detailed Terms and Conditions of a given service.

2.13 Exclusive rights to the content made available as part of the services, in particular copyrights, the name of the Website (trademark), its graphic elements, other trade names, software, and database rights are protected by law. The use of trademarks, graphic elements, and names used on the Website is prohibited without the written consent of IPH.

3. Scope and terms of use of the Website

3.1 The agreement for the provision of electronic services by IPH for viewing the content of the Website and using its functionality is concluded upon entering the Website. The agreement is concluded for an indefinite period, unless the provisions of these Terms of Service provide otherwise. Use of the Website is free of charge.

3.3 In the event of persistent violation of the Terms and Conditions by the User, the agreement may be terminated by IPH with seven days’ notice.

3.4 IPH reserves the right to modify the technical manner of service provision, in accordance with the scope and conditions resulting from its rights, as well as in accordance with its technical capabilities, without impairing its quality and without affecting the scope of rights and obligations of the parties.

4. Rules for using the Website

4.1 The User is obliged in particular to use the Website in a manner that does not interfere with its functioning, in accordance with the provisions of law in force in the territory of the Republic of Poland, the provisions of the Regulations, as well as with accepted customs in a given area. The User is not entitled to use the Website to provide illegal content.

5. Complaints

5.1 IPH shall take measures to ensure the fully correct functioning of the Website and services, to the extent resulting from current technical knowledge, and undertakes to remove any irregularities reported by Users within a reasonable time.

5.2 Irregularities related to the functioning of the Website or services, as well as complaints, may be reported by the User to the e-mail address bok@mojpos.pl.pl with the subject line “Complaint”.

5.3 The date of submission of the complaint shall be the date on which the complaint is sent to IPH.

5.4 Complaints will be considered and resolved within 14 days of receipt.

6. Applicable law and disputes

6.1 The law applicable to the agreement between the User and IPH, the subject of which are services provided by IPH under the terms and conditions set out in the Terms and Conditions, is Polish law. Any disputes related to the services provided by IPH through the Website shall be settled by the competent Polish common courts.

6.2 A User who is a consumer may use an out-of-court complaint and redress procedure before the Permanent Consumer Arbitration Court at the Provincial Inspectorate of Trade Inspection in Warsaw. 6.3 Users who are consumers also have the option of using the ODR online platform, available at the following internet address: http://ec.europa.eu/consumers/odr/.

7. Final provisions.

7.1 IPH reserves the right to amend these Terms and Conditions at any time, of which the User will be notified at least 15 days in advance by publishing relevant information on the Website via a pop-up window. Amendments to the Terms and Conditions shall not limit the rights acquired by Users prior to the amendment of the Terms and Conditions. Amendments to the Terms and Conditions shall become effective on the date specified in the new Terms and Conditions posted on the Website.
